Resolution of Discrimination Investigation Against Native American Students in Rapid City Area Schools by U.S. Department of Education’s Office for Civil Rights in South Dakota

The Office for Civil Rights (OCR) of the U.S. Department of Education has announced that the Rapid City Area Schools district in South Dakota has reached a resolution agreement to uphold compliance with Title VI of the Civil Rights Act of 1964 concerning school discipline and the administration of advanced learning programs.

An investigation by OCR uncovered disparities in the treatment of Native American and white students in the district’s disciplinary processes and access to advanced learning opportunities.

Evidence revealed that Native American students faced more frequent and harsher disciplinary actions compared to their white peers, and they were also unfairly disadvantaged in accessing advanced learning programs such as honors and Advanced Placement courses.

To address these issues, the district has committed to various actions, including investigating the root causes of discrimination, appointing specialized staff to oversee equity in discipline and advanced learning, forming a committee with Native American community members, revising policies, analyzing data for potential discrimination, providing staff training, and reporting data transparently.

“The Rapid City Area School district has pledged to promote equality for Native American students through this agreement,” stated Assistant Secretary for Civil Rights Catherine E. Lhamon. “OCR is eager to collaborate with the district to enhance educational opportunities for all students.”
